                                            RESTRICTIONS FOR

RIVER CLIFF (LOTS 1 THRU 68)

A.  The following shall apply to Lots 19 thru 44 and lots 50 thru 62:

  • 1.  These lots shall be utilized for single family homes only and shall contain only one such dwelling per lot.
  • 2.  The minimum finished area of these homes shall be 1,200 square feet excluding basements or garage.  If second floor (upstairs) is utilized, then no less than 1,000 square feet on the first floor with balance (or more) on second floor.
  • 3.  All homes shall contain a two car attached garage with finished floor elevation no greater than 24 inches less than first floor elevation.
  • 4.  Crawl space, foundation walls, and adjoining porches may be poured concrete or concrete block, but all visible portions thereof shall be covered with brick veneer.
  • B.  The following shall apply to Lots 5 thru 16, 18, 45 thru 49, and 63:
  • 1.These lots shall be utilized for single family homes only and shall contain only one such dwelling per lot.
  • 2.  The minimum finished area of these homes shall be 1,800 square feet excluding basements or garage.  If second floor (upstairs) is utilized, then no less than 1,500 square feet on the first floor with balance (or more) on second floor.
  • 3.  All homes shall contain a two car attached garage with finished floor elevation no greater than 24 inches less than first floor elevation.
  • 4.  All foundations and/or basements shall be poured concrete with all visible portions thereof covered with brick veneer.
  • 5.  All structures shall contain at least 75% brick veneer or stone on the exterior vertical surface unless approved otherwise by the developer.
  • C.  The following shall apply to Lots 1 thru 4:

  • D.  The following shall apply to all Lots (total of 68)
  • 1.  These restrictions may be changed if 75% of the individual owners of each lot decide to do so (51 lot owners out of 68 lots at this time) (one lot, one vote).
  • 2.  Lot 17 may be used for C-2 development.  All other remaining designated lots shall be used for residential purposes only (R-1 or R-3 development as shown on plat).
  • 3.  No R-3 structure shall be permitted whose area of the main structure, exclusive of the one story open porches, garages, and finished basements is less than 700 square feet per unit and must be set on a concrete or finished concrete block foundation with brick veneer covering all exposed areas.
  • 4.  No junk, inoperative automobiles or uncleaned automobiles shall be allowed upon the premises except in a garage where the same shall not be visible to adjoining property owners or from the public right-of-way.
    5.  No noxious or offensive trade or activity shall be carried on upon the real estate, nor shall anything be done thereon which may be or may become an annoyance to the neighborhood unless allowed herein.
  • 6.  The real estate shall not be used or maintained as a dumping ground for rubbish, etc.  Trash, garbage, or other waste shall be kept in sanitary containers.  All incinerators or other equipment for the storage or disposal of such material shall be kept in a clean and sanitary condition.
  • 7.  No animal shall be kept upon the real estate except commonly accepted domestic pets.  No swine, cows, chickens, or goats shall be allowed to be kept on the premises.  Horses are allowed on lots 34, 35, and 57.
  • 8.  Property owners shall confine their pets, be they feline, canine, reptile or whatsoever, within an enclosure or upon a leash, at all times.
  • 9.  No lot in said development may be subdivided into additional lots of less than 15,000 square feet.  Lots may be split with each divided portion added to the adjacent whole lot per minor subdivision plat recorded in the clerk’s office.  Easements not used may be revised via this process.
  • 10.  All residential structures proposed for this development shall be constructed on the site with a minimum roof pitch of 5:12.  There shall be no single wide, double wide, mobile homes, A-frame, berm (earth shelter), basement, or log homes permitted in the subdivision.
  • 11.  All lots located in said subdivision are subject to utility easements shown on the plat and each owner grants to the utility companies the right of ingress and egress for the purpose of constructing, maintaining and repairing gas, water, electric, sewage, telephone, cable T.V. and other public utilities.  All utilities (water, electric, cable and telephone) must be placed underground from the main utility line to the residential structure being built.
  • 12.  No buildings shall be erected between any street and the building setback line as shown on the plat.
  • 13.  All driveways constructed on any lot in said development shall be of concrete or asphalt from the street to the garage and shall be paved accordingly within 1 (one) year of house completion.
  • 14.  No trailers, campers, or motor homes, except personal vehicles in full operating order, shall be permitted to be parked at any time in the area between the house and street nor within any building setback line.
  • 15.  No signs or other advertising shall be displayed on any R-1 lot.  Excepted from this restriction are house numbers, plates identifying the lot or resident of said lot, real estate sales signs, or temporary political election signs.
  • 16.  No business or commercial activity of any kind shall be carried out upon the premises unless approved by the developer.
  • 17.  All lot owners are responsible for soil conservation practices, such as seed and straw to avoid soil erosion.
  • 18.  All lot owners must install driveway entrances as permitted by the city or Commonwealth of Kentucky.
    19.  Only one residence per recorded R-1 lot shall be allowed.
    20.  Invalidation of any one of the covenants by judgement of court order shall in no way affect any of the other provisions which shall remain in full force and effect.  The covenants, conditions and restrictions herein contained shall run with the land and shall be binding on all assigns.  Enforcement shall be by proceedings at law or in equity against any persons violating or attempting to violate any covenant, either to restrain said violation or to recover damages for the violation.
  •   21.  Only brick or stone mailboxes shall be allowed on River Cliff Boulevard.  See mailbox standard on record plat.
  • 22.  All vegetative debris from lot clearing such as trees, limbs, root wads, laps, etc. shall be removed  during or prior to construction.
  • 23.  Grass areas on vacant lots shall be mowed when its length exceeds 10 inches in   height.  If the developers have to mow this grass due to non-compliance by the owner, the cost of this work shall be passed on to said owner.
  • 24.  No porch and/or porch railing facing the street (front of house shall be facing street) shall be constructed of exposed wood.  Any exception to this restriction must be approved by the River Cliff developers.
